An agreement for the division of matrimonial property is a contract that facilitates the division of assets acquired by spouses during their marriage. To conclude such an agreement, spouses must first establish a separation of property (which can be done immediately before the property division agreement) or already be divorced. We then divide the assets between the spouses (or former spouses). The agreement can be onerous, meaning it involves payments or supplementary payments from the other spouse, or gratuitous, meaning it does not involve any payments or supplementary payments from the other spouse.
