Agreements for the Division of an Estate

An agreement for the division of an estate is a contract that facilitates the division of assets acquired through inheritance. This means we reassign specific estate components to particular individuals (e.g., one person acquires an undeveloped plot of land, another an apartment, and a third a plot with a house). The agreement can be onerous, meaning it involves payments or supplementary payments from the other co-owners (or some of them), or gratuitous, meaning it does not involve any payments or supplementary payments from the other co-owners.

Information Required for Concluding the Agreement:

  1. Details of the parties involved: Full name, parents' names, PESEL number (if unavailable, date and place of birth), residential address (and correspondence address, if different), identification document number, place of birth (city and country), and citizenship.
  2. Land and Mortgage Register (Księga Wieczysta) number.
  3. Financial settlements: Indicate whether any settlements will occur between the parties as a result of the agreement, and if so, what kind (you should specify which party is paying and the amount and due date of the payment or repayment).
  4. Any other additional agreements.
